Welcome to The Cookie Kid. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from The Cookie Kid through our online store.

By visiting our website, placing an order, or purchasing from us, you agree to these Terms. Please read them carefully before using our website or completing a purchase.

1. ABOUT THE COOKIE KID

The Cookie Kid is a Florida-based small business offering homemade cookies, baked goods, merchandise, and other products.

2. ONLINE STORE TERMS

By using this website and placing an order, you represent that you are legally able to enter into a purchase agreement or that you are using the website with the permission and supervision of a parent or legal guardian.

You may not use our products, website, or services for any unlawful or unauthorized purpose.

We reserve the right to refuse or cancel an order when reasonably necessary, including in cases of suspected fraud, pricing or inventory errors, misuse of promotions, or circumstances that prevent us from safely or legally fulfilling an order.

3. PRODUCT AVAILABILITY

All products are subject to availability.

Because our cookies are made in small batches, certain flavors or products may sell out quickly. Adding an item to your cart does not guarantee availability until your order has been successfully completed.

We may change, discontinue, or limit quantities of products at any time.

Product photographs are intended to represent our products as accurately as possible. Because our cookies are handmade, appearance, size, color, toppings, drizzle, and other details may vary slightly from photographs.

4. PRICING AND PAYMENT

Prices are listed on our website and may change at any time without prior notice.

The price charged for an order will generally be the price displayed when the order is submitted, subject to correction of obvious pricing or technical errors.

Applicable taxes, shipping charges, delivery charges, or other fees will be displayed during checkout when applicable.

Payment must be successfully processed before an online order is considered confirmed.

5. LOCAL PICKUP

Customers selecting local pickup are responsible for picking up their orders during the designated pickup date, time, or availability window provided by The Cookie Kid.

Please carefully review pickup information before completing your order.

Because cookies and other food products are perishable, orders that are not picked up as scheduled may not qualify for a refund or replacement.

6. SHIPPING

We take reasonable care when preparing and packaging orders for shipment.

Shipping and delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.

Once a package has been transferred to the shipping carrier, delays caused by the carrier, weather, incorrect addresses, holidays, or other circumstances outside our reasonable control may occur.

Customers are responsible for providing a complete and accurate shipping address at checkout.

If an order is returned or cannot be delivered because an incorrect or incomplete address was provided, additional shipping charges may apply before the order can be resent.

Because our cookies are food products, we cannot guarantee that shipped cookies will arrive in exactly the same cosmetic condition in which they left our kitchen. Minor breakage, shifting, melting of certain toppings, or other changes caused during transit may occur.

If your order arrives significantly damaged or there is a problem with your shipment, please contact us promptly and provide photographs of the package and affected products so we can evaluate the issue.

7. FOOD ALLERGIES AND CROSS-CONTACT

IMPORTANT ALLERGY NOTICE

Products from The Cookie Kid may contain or come into contact with common food allergens, including but not limited to:

Wheat, milk, eggs, soy, peanuts, tree nuts, and other allergens.

Our products are prepared in a kitchen where multiple ingredients and allergens may be handled.

We cannot guarantee that any product is completely free from allergens or cross-contact.

Customers with severe or life-threatening food allergies should carefully consider this information before purchasing or consuming our products.

Ingredient information is provided on product packaging when required and may also be available upon request.

8. GLUTEN-FRIENDLY PRODUCTS

Products identified as “gluten friendly” are not represented or guaranteed to be gluten-free.

The Cookie Kid does not operate a dedicated gluten-free kitchen, and gluten-friendly products may be prepared in an environment where wheat and gluten-containing ingredients are handled.

Cross-contact is possible.

Customers with celiac disease, severe gluten allergies, or other medical conditions requiring strict avoidance of gluten should use their own judgment and consult an appropriate healthcare professional regarding whether these products are suitable for them.

9. FLORIDA COTTAGE FOOD PRODUCTS

Certain food products sold by The Cookie Kid may be produced and sold pursuant to Florida’s cottage food laws.

Where required by applicable law, cottage food products will contain the appropriate labeling and disclosures.

Customers acknowledge that cottage food products may be produced in a home kitchen that is not subject to the same regulatory requirements as a licensed commercial food establishment.

10. CUSTOM, BULK, EVENT, AND FUNDRAISING ORDERS

Custom, bulk, event, catering, fundraising, or special orders may be subject to additional requirements, minimum quantities, deposits, deadlines, and cancellation policies.

An order is not considered confirmed until any required payment or deposit has been received and confirmation has been provided by The Cookie Kid.

Because these orders may require advance purchasing, scheduling, and preparation, deposits or payments for custom orders may be non-refundable once preparation or purchasing has begun.

Specific terms communicated and agreed upon for a custom order will control if they conflict with this general policy.

11. REFUNDS, RETURNS, AND REPLACEMENTS

Because cookies and other food products are perishable, all food sales are generally final.

We do not accept returns of food products.

If we made an error with your order or your order arrives significantly damaged, please contact us promptly at thecookiekid26@gmail.com.

We may request photographs or additional information before issuing a replacement, store credit, or refund.

Refunds and replacements are evaluated based on the circumstances of each order.

Non-food merchandise may be subject to separate return or exchange terms displayed on the applicable product page or elsewhere on our website.

12. ORDER CANCELLATIONS

Cancellation requests should be submitted as soon as possible.

Because cookies are made specifically for scheduled sales, pickups, shipments, or orders, we cannot guarantee that an order can be canceled after it has entered preparation.

Orders that have already been baked, prepared, customized, packaged, or shipped may not be eligible for cancellation or refund.

13. PROMOTIONS, DISCOUNTS, AND GIFT CARDS

Promotional offers, coupon codes, discounts, sales, and special pricing may be subject to additional restrictions.

Unless otherwise stated, promotions cannot be combined.

We reserve the right to modify or end a promotion at any time, subject to applicable law.

Gift cards and store credits are subject to applicable law and any additional terms provided when issued.

14. MERCHANDISE AND THIRD-PARTY FULFILLMENT

Certain merchandise may be produced, fulfilled, or shipped by third-party providers.

Delivery times, production times, and availability for these products may differ from our cookie orders.

When third-party fulfillment is used, The Cookie Kid is not responsible for delays or disruptions outside our reasonable control, but customers should contact us if they experience a problem with an order.

15. INTELLECTUAL PROPERTY

The Cookie Kid name, logos, original graphics, photographs, product names, designs, website content, and other original materials belonging to The Cookie Kid may not be copied, reproduced, sold, distributed, or commercially used without permission, except as permitted by applicable law.

Nothing in these Terms transfers ownership of The Cookie Kid’s intellectual property to the customer or website visitor.

16. CUSTOMER CONTENT AND REVIEWS

If you voluntarily submit a review, photograph, testimonial, comment, or other content to The Cookie Kid, you represent that you have the right to submit that content.

We may ask for permission before using customer photographs or other identifiable customer-created content for promotional purposes when appropriate.

We make reasonable efforts to keep product descriptions, prices, availability, photographs, and other information accurate.

Occasionally, information may contain typographical errors, inaccuracies, or omissions.

We reserve the right to correct errors and update information when necessary.

Your use of certain third-party services may also be governed by those providers’ terms and privacy practices.
